Regina M. Benjamin, M.D., M.B.A., was appointed by President Barack Obama as the 18th United States Surgeon General in July, 2009 and served a four-year term. Dr. Benjamin also oversaw the operational command of 6,700 uniformed public health officers who serve in locations around the world to promote, and protect the health of the American People. Dr. Benjamin served simultaneously as Surgeon General and as the first chair of the National Prevention, Health Promotion, and Public Health Council (National Prevention Council) - 17 cabinet-level Federal agencies that developed the road map for the Nation’s health – The National Prevention Strategy.

Before becoming “America’s Doctor,” she served her patients at the rural health clinic she founded in tiny, Bayou La Batre, Alabama, keeping the clinic in operation despite damage and destruction inflicted by Hurricanes Georges (1998) and Katrina (2005) and a devastating fire (2006).

She has a B.S. in chemistry from Xavier University of Louisiana, an M.D. degree from the University of Alabama at Birmingham and an M.B.A. from Tulane University. She attended Morehouse School of Medicine and completed her family medicine residency in Macon, Georgia. Dr. Benjamin is the recipient of 22 honorary degrees.

She is former associate dean for Rural Health at the University of South Alabama College of Medicine in Mobile and past chair of the Federation of State Medical Boards of the United States. In 1995, she was the first physician under age 40 and the first African-American woman to be elected to the American Medical Association Board of Trustees. She served as president of the American Medical Association Education and Research Foundation and chair of the AMA Council on Ethical and Judicial Affairs. In 2002, she became the first African-American female president of a state medical society in the United States when she assumed leadership of the Medical Association State of Alabama.

Today's Flash Back Friday comes from Episode 117, from December 2012.

In light of the recent election results, thousands of people across the United States started petitions to the government requesting that their state secede from the Union.  Drew Zahn, news editor at WND, joins Jason Hartman for a discussion about this movement that immediately followed on the heels of Obama’s re-election.  Drew and Jason talk about states’ rights, pointing out that many citizens feel our individual rights are also being infringed upon through some of President Obama’s mandates, such as healthcare reform.  The movement began with one gentleman in Louisiana asking for a peaceful secession from the Union for his state and very quickly snowballed.  Drew explains the legality involved in secession, noting that there are three ways that a state can leave the Union.  Citizens in all 50 states have petitioned the White House, with many states having acquired more than enough signatures to meet the requirement of the government’s policy for petitions.  Jason and Drew discuss the ramifications, good, bad and difficult, of a state actually legally seceding.

Sunday night in Las Vegas shook the town and, tragically, saw the loss of life to over 50 and caused injuries to over 400 participants at the Route91 Christian Music Festival. The deranged gunman who fired at them was shooting from the Mandalay Bay hotel, where Jason Hartman happened to be attending a meeting.

Jason took some time Monday evening to reflect on his experience as the realization dawned on him, and the other meeting attendees, that someone was shooting at people on the ground. He also talks to his friend, Larry, who stayed at the meeting a little longer and ended up being locked into the hotel and having to spend the night in the meeting room. Larry tells about the scare they received in the room, how the situation was handled, and when he was allowed to leave.

Today's Flash Back Friday comes from Episode 121, from January 2013.

Airplane safety has improved significantly, but there are improvements that can still be made to remove the fear that many people feel when boarding a plane. Author Dave Soucie joins Jason Hartman on this episode to talk about advances in safety and what still needs to be done. The biggest concern today is complacency, while the biggest improvement has been the implementation of Aviation Safety Information Analysis & Sharing (ASIAS), which allows for the exchange of information on precursors that may cause accidents down the road. David’s take on this is that there is a lot of room for improvement yet. He states that even the passengers are part of the safety system, stressing they need to be aware and if they see something concerning, be bold and speak up. David describes the FAA’s responsibilities and the standard regulations around the world. He also talks about the importance of the TSA, not disregarding blatant overstepping by some TSA agents, but the necessity of keeping airspace safe.

There have been many horrific airline crashes and David tells the stories behind those crashes. The way accidents are most often looked at is pilot error. But David asks the question, what caused the problem in the first place that resulted in a pilot needing to troubleshoot? The initial cause can be critical, such as faulty equipment that the airline companies know need to be replaced, but choose not to do immediately.  David and Jason close with general aviation tips and advice. Airplane crashes may be rare, but they do happen, and they’re usually fatal.  David Soucie insists that most of these deaths could be prevented.

Soucie’s worked in the cockpit, on the hanger floor, within the aviation boardroom, and inside the Washington D.C. beltway.  He’s seen death up close and personal - deaths of colleagues and friends that might have been prevented if he had approved certain safety measures in the aircraft they were handling.  This memoir is a gripping description of what Soucie saw and experienced as he worked in the aviation industry.  He’s now focused on understanding the hazards and risks of air travel.  As such, he is a regular consultant on the topic, from advising the Obama administration on airline safety management systems to taking a leading role as industry representative in the congressionally funded NextGen interdepartmental initiative to examine the challenges of aviation in the near future, not only for the Department of Transportation, but also for the departments of defense and Homeland Security, NASA, and the Office of National Intelligence. Since leaving the FAA in 2006, Soucie has analyzed nearly every major air disaster.  From January 2007 to June 2010, there were 240 commercial airplane accidents, 28 crashes on scheduled airlines that resulted in 1,795 deaths.

The original intent of a jury was to keep government tyranny in check. In today’s legal system, jurors are rarely told that they have this power. Jason Hartman interviews legal scholar and civil liberties activist, Roger Roots, on the responsibilities of juries and the Constitutional purpose of juries. Roger explains cases of unfair advantage by the U.S. Justice Department, where jurors are often directed and instructed by judges as to what convictions they may bring against a person, without being given the opportunity to review the laws. The full function of the jury is to be a final check and balance on the government legal system. Roger also discusses violations of First Amendment rights, corrupt laws, political involvement in corporations and markets, and how the violations against our First Amendment rights squelches the voice of the people who try to expose corruption. Roger talks about his work with the Fully Informed Jury Association, where he has pushed for legislation in favor of juries being fully informed of their rights and duties and the overturning of various small laws that prevent our legal system from working as our Founding Fathers intended.

Dr. Roger Roots is a nationally recognized criminologist, legal scholar and civil liberties activist. He is active in libertarian politics, and in the promotion of a freer, fairer and more just world. He is the author of more than two dozen noteworthy scholarly articles, and some of his research has been relied on by federal courts. He is an advocate for the rights of the disenfranchised, the downtrodden and the politically estranged. In recent years, Roots has focused his work and advocacy on three areas: the fully informed jury movement, the reestablishment of Fourth Amendment protections and the establishment of a fair and equal court system for all participants. Roots has has published an important article on the lopsided procedural rules of the federal court system, “Unfair Rules of Procedure: Why Does the Government Get More Time?” which appeared in The American Journal of Trial Advocacy in 2010. He has applied for two major research grants to continue and pursue this research, and he hopes to secure research funding to pursue this research in the near future. In 2011, Roots initiated a formal request to U.S. Chief Justice John Roberts, chair of the United States Judicial Conference, in the hopes that certain unfair advantages for the U.S. Justice Department can be removed from the Federal Rules of court procedure. This work is ongoing. Roots has argued that various filing requirement disparities in the Federal Rules of Civil, Appellate and Supreme Court Procedure give an unfair advantage to the U.S. Justice Department in civil and criminal litigation, and that this advantage is compounded over time. This advantage places the poor and minorities in an especially disadvantaged position. Roots has presented academic papers on the topic before the Law and Society Association national conference and the annual meeting of the American Society of Criminology.

During the 2011 Montana legislative session, Roots coauthored legislation that became House Bill 332, introduced by Representative Bob Wagner, to require Montana judges to fully inform juries of their absolute right to acquit and to determine the law in jury trials. The legislation did not get out of the House Judiciary Committee, but Roots has redrafted a proposed bill for the 2013 Legislative Session. Roots has also coauthored and sponsored a proposed constitutional amendment in Montana requiring juries in criminal trials be instructed regarding their power to review the law. On May 26, 2011, the Montana Secretary of State approved the proposed constitutional amendment (CI-107) for circulation as a ballot initiative. Dr. Roots is a member of the Board of Advisers of the Fully Informed Jury Association (www.FIJA.org), America’s oldest and largest educational organization solely dedicated to informing jurors and potential jurors of their lawful heritage, purpose and powers. Roots was a featured speaker at the 2008 Libertarian Party National Convention in Denver, Colorado regarding fully informed juries. He has been interviewed by The Orlando Sentinel and other publications regarding the rights and powers of juries. In February, 2011, he addressed a packed crowd at the New York City Junto Meeting at the Great Society Library in Manhattan, along with Professor Julian Heicklen, America’s foremost street advocate for fully informed juries. In recent years, Roots has studied the origins of search-and-seizure protections and has launched a long-term research project into the original intent behind the U.S. Constitution’s Fourth Amendment. In 2009, Roots published a major article on the subject, “The Originalist Case For the Fourth Amendment Exclusionary Rule,” Gonzaga Law Review, Vol. 45, pp. 1-66. The article has been the topic of academic discussions on the Volokh Conspiracy and other venues. Roots is currently engaged in research into the provenance of certain Founding-Era British books and pamphlets held in American rare book libraries. In 2010, Roots was awarded a research grant from the New York Institute of Technology to continue this research. This research focuses on the question of whether any of America’s Constitutional Framers owned or had access to these pamphlets prior to the drafting and ratification of the Fourth Amendment. (The larger research question is whether pre-Framing discussions of (what became) the Fourth Amendment exclusionary rule in British pamphlets were read or discussed by America’s Founding Fathers.

Dr. Roger Roots has also taught criminal justice and sociology classes at the college level, a pursuit he greatly enjoys. He especially enjoys teaching legal history and constitutional criminal procedure. Although he began his adult life as a high school dropout and an ex-convict, he now holds a Bachelors degree in Sociology from Montana State University—Billings, a Masters degree in Criminal Justice Science from Roger Williams University in Bristol, Rhode Island, a law degree from Roger Williams University, and a Ph.D. in Sociology from the University of Nevada, Las Vegas (UNLV). Roots was an honor student throughout higher education, and kept a Deans Scholarship in all three years of law school. On two occasions, he entered and won national legal writing competitions. His mentor at UNLV was the great Las Vegas gambling researcher Frederick Preston, who founded the doctoral program in Sociology at UNLV. His outside dissertation advisor was none other than Hans-Hermann Hoppe, the great libertarian economist and author of the landmark book, Democracy: The God That Failed who inherited the Murray Rothbard professorship at UNLV. As an attorney Roger Roots has worked on a variety of civil and criminal cases. He is the only lawyer in the history of the U.S. 8th Circuit to ever overturn a conviction on venue grounds. United States v. Stanko, 528 F.3d 581, 584 (8th Cir. 2008). Here is the winning brief. Roots has also worked on litigation concerning America’s lost legacy of grand jury oversight, a topic he has studied and written about on numerous occasions. Roots’ legal scholarship has been cited in the Harvard Law Review and the Yale Law Journal and been relied on by courts across the United States. (See, e.g., Baur v. Veneman, 352 F.3d 625 (2d Cir. 2003); United States v. Marcucci, 299 F.3d 1156, 1162 (9th Cir. 2002); United States v. Holmstrom, 246 F.Supp.2d 1101, 1110 (E.D.Wash. 2003)). Roots is an infrequent blogger for some of America’s premier libertarian websites, including Lewrockwell.com and Nolanchart.com. He was a featured speaker at the 2002 Nevada State Libertarian Party Convention and at the 2008 National Libertarian Party Convention in Denver, Colorado. He has also spoken before the Austrian Scholars Convention of the Ludwig Von Mises Institute in Auburn, Alabama. Dr. Roots is a founding member of the Wall of Tolerance, co-founded by Rosa Parks, whose courageous stand against authoritarian government in 1955 showed millions of others how to resist government by simply saying no.

His work is focused primarily on reef fish ecology and on management of the coral reefs. He has conducted research in Hawaii, Australia, the Caribbean, and the Middle East, as well as many reefs in between. He has successfully developed and guided projects in international development and sustainable coastal marine management in the Caribbean and Indo-Pacific. Peter has been a faculty member at University of Sydney, Australia, University of New Hampshire, and University of Windsor, Canada. He is currently the Assistant Director of the Institute for Water, Environment and Health at the United Nations University, based in Hamilton, Ontario. In Peter’s book, Our Dying Planet, he makes the argument that the complex and very serious problem of our global environmental crisis can be solved, has to be solved, and must be solved soon.

Geoffrey Simmons (born 1943) is a medical doctor, author, lecturer, trainer and intelligent design advocate in Eugene, Oregon. He is a doctor of internal medicine for the Peacehealth Medical Group in Eugene, boarded in internal medicine and disaster medicine.

Simmons is a fellow at the Center for Science and Culture, part of the Discovery Institute. In early 2006 Physicians and Surgeons for Scientific Integrity, headed by Rich Akins (was not established by the Discovery Institute, but as a nonprofit anti-evolution organization). Of its activities, the PSSI held a “Doctors Doubting Darwin” rally in September, 2006. Also there was PSSI tour of Spain with the Spanish version of What Darwin didn’t know, to five cities, Barcelona, Malaga, Madird, Leon and Viga, ten lectures altogether. He has lectured on several college campuses, many churches and a few synagogues. Simmons also teaches disaster preparedness locally, regionally and nationally.

With spring coming into full swing, so are ticks and the warnings of Lyme disease. But just how serious is this disease? Jason Hartman interviews Tom Grier, Executive Director of Pathology Studies at MIBDEC, a non-profit organization. Tom tells his horrendous personal experience with Lyme disease that went undiagnosed for years, and was reluctantly diagnosed with Multiple Schlerosis. He shares his story of new symptoms that popped up continuously, including a constant severe pressure in his head. Finally, one doctor looked at his chart and told him that he had late stage Lyme disease. Tom discusses the conspiratorial angle between insurance companies and scientists and doctors, which has led to many people not being treated properly for the disease.

Tom studied Clinical Immunology and Microbiology at the University of MN Duluth, and began a doctorate program in Geriatrics until the program was discontinued. Currently, Tom is the Executive Director of Pathology Studies at MIBDEC. MIBDEC is an non-profit organization trying to register Dementia and MS patients to donate their brains to science to look for spirochetes (Lyme) as a possible connection to some (not all) dementias. He does this because of the refusal by health departments, the NIH or CDC to do the proper work to rule out spirochetes within the brain as a cause of our increased rate of dementia in America and around the temperate latitudes of the Northern Hemisphere. Also like many in his field, he is concerned about the government not telling us the truth about epidemic diseases and the purposely funding of bad science. There are also conflicts of financial interest that prevent good science from prevailing.

Edward Griffin, author of The Creature from Jekyll Island, a film producer, author, and political lecturer. G. Edward started his life as a child actor, then became a radio station manager before turning 20. He was hired to write for the 1968 Wallace campaign, then pursued a career of producing documentaries and books on controversial topics like cancer, Noah’s ark, and the Federal Reserve. He also delved into libertarian theories of the U.S. Supreme Court, terrorism, subversion, and foreign policy. He believes the Federal Reserve is a scam, charging it with being a banking cartel and an instrument of war and totalitarianism. In 2002, Griffin founded the individualist network Freedom Force International.

Since this interview, G. Edward has gone on to write several other books, including one of his newest, The End of Freedom: How Our Monetary System Enslaves Us. He was also recently the keynote speaker at Jason's Meet the Masters event.

Howard Schnellenberger learned his football tactics as a player for “Bear” Bryant and Blanton Collier at the University of Kentucky. He served as an assistant to Bryant at Alabama, moved on to pro ball as an assistant to George Allen (Rams) and Don Shula (Dolphins). He was head coach of the Baltimore Colts from 1973-74. He and his wife Beverlee have three sons: Stephen, Stuart and Tim. Stuart was a tight end/center on his father’s 1983 national championship team. Grandchildren are Teather Ann, Joey and Marcus.

Howard Schnellenberger has been part of four collegiate national championships. His 1983 Miami Hurricanes won that school’s first title, defeating Nebraska in the 50th Anniversary Orange Bowl. Eric is from Detroit, Michigan.  He was politically interested from an early age, and in the late 1960s, he began to follow political developments through magazines and the Wall Street Journal. In 1976, he attended a speech in Detroit by economist Milton Friedman. It happened to be the day that Friedman was awarded the Nobel Prize in Economics.
